What is pre-settlement funding?

Pre-settlement funding, sometimes called a lawsuit loan, lawsuit cash advance, or settlement advance, is money paid to an injured person before their personal injury claim resolves. It is non-recourse: you repay it only out of your settlement or court award. If the claim ends with no recovery, you owe nothing.

Because repayment depends on the case and not on you, there's no credit check, no income verification, and no monthly bill. Most people use the money for rent or mortgage payments, car payments, utilities, groceries, and other everyday costs while they recover.

Is pre-settlement funding a loan?

No. It's a non-recourse advance against your future recovery. Unlike a loan, you make no monthly payments and you owe nothing if your case ends without a recovery. Repayment comes only from your settlement or judgment.

What happens if I lose my case?

You owe us nothing. That risk is ours, not yours. The few exceptions, such as fraud, are written plainly in the contract.

Do I need to have filed a lawsuit to get funding?

No. Many injury claims settle directly with the insurance company. If you have an attorney and your claim is pending, you can apply whether or not a lawsuit has been filed.

How much pre-settlement funding can I get?

Do you check my credit or employment?

Information we collect

Information you give us: your name, phone, email, address, details about your accident, injuries, and claim, your attorney's contact information, and the amount you request. Information from your attorney: case documents and status updates you authorize them to share. Information collected automatically: basic device, browser, and usage data through cookies and similar tools.

How we use it

To review your application, communicate with you and your attorney, prepare and service your funding agreement, prevent fraud, meet legal obligations, and improve our website. We do not sell your personal information.

Who we share it with

Your attorney and their staff; service providers who help us operate (for example, hosting, email, e-signature, and payment processing) under confidentiality obligations; and government authorities when required by law. If Ark is involved in a merger or sale of assets, information may transfer as part of that transaction.

Calls and texts

If you give us your phone number, you agree that we may call or text you about your application and funding. Message and data rates may apply. You can opt out at any time by replying STOP or emailing apply@arklegalfund.com. We will not send marketing texts without your separate consent.

Confidentiality of your case

We treat case information as confidential and ask for only what we need to evaluate funding. We do not contact the defendant or the defendant's insurer.

Security and retention

We use reasonable administrative, technical, and physical safeguards. We keep information as long as needed for the purposes above and as required by law.

Your choices

You may ask to see, correct, or delete the personal information we hold, subject to legal and contractual limits, by emailing apply@arklegalfund.com.

Children
